I am currently making efforts to resolve the recent NFT copyright infringement case I have been experiencing.

DMCA is the keyword for protecting copyright in the online era, and most of the platforms we commonly use operate reporting channels and mechanisms to address DMCA violations. Today, I will introduce the reporting methods for each platform.

0. Essential Information Preparation

First, the common point to check is that to file a copyright report, you must have objective data that can prove that you are the copyright holder.

In my case, I prepared materials sold on the Asset Store, the deposit details received through the Asset Store, and a passport with the corresponding English name written on it.

And copyright infringers must be able to clearly identify information that is clearly infringing copyright. In my case, since I am selling only through the Unity Asset Store, I checked the Unity Asset Store user license items through the Unity legal team, and after confirming that NFT sales infringe copyright, I filed the report.

First, we recommend referring to the content that introduces the DMCA reporting procedure from a company that creates legal books for the general public, as guided by the Unity legal team.

1. Meta (Facebook)

For Facebook, an online copyright report form is provided as shown above. After reporting, Facebook will contact you asking for proof that you are the copyright holder.

However, in my case, despite submitting materials faithfully following my lawyer's advice, they processed the request without explaining the reason.

I personally felt that the handling was done very roughly.

2. Twitter

For Twitter, the process is very fast. However, when reporting a specific tweet, they usually complete the processing within about 30 minutes.

In cases like mine where there is an issue with the account itself, it seems they consider it when you report a tweet multiple times, or when you report multiple tweets at once.

Unfortunately, I have not yet received confirmation that the request has been processed. I will delete the individual tweets immediately.

3. Discord

For Discord, you need to create a PDF file accessible via the page above. There is nothing particularly difficult about it; if you submit the file properly, they will process it within about a week if there are no issues.

For YouTube, this was the first report I filed, and it was processed the fastest. I did not delete the account itself, but they removed the videos.

Especially for YouTube, they kindly provided guidance in Korean when information was insufficient or additional information was required.

It was a somewhat unexpected field. Actually, thinking logically, since Telegram is a chat app that operates very anonymously, I wondered if copyright protection existed... but apparently, as shown above, DMCA takedown notices are possible for bots, channels, and sticker packs.

As a result, as shown above, it seems the process will be completed once I send the additional copyright proof materials. However, I am currently explaining that around the time I receive this response, the problematic Beta Team members are contacting me again, stating they want to reach an agreement.

Else...

In addition, platforms like Reddit and Medium also operate DMCA reporting channels. However, they request more detailed information or information that can prove you are the copyright holder to confirm the specific details.

And as I searched, I found that there is a site with the domain dmca.com that also offers this service. However, since it requires a cost close to $199 per site, I'm not sure how it will be.

However, since I spent nearly three weeks on this, looking at the hourly cost, it doesn't seem particularly expensive. Also, since I haven't used it myself, I can't really comment on whether it's good or bad.

!!!! Important Points !!!!

However, if you wish to file a DMCA takedown request during this process, you must be aware that your essential personal information, such as the copyright owner's name and address, will be disclosed to the copyright infringer.

When I first applied, I didn't know about this and was surprised to hear that I would be notified later, but it felt really uncomfortable.

So, I think it would be good to consult with someone who can legally act on your behalf, like a lawyer, as it seems like this would prevent the leakage of personal information or other unpleasant details being leaked to others..

However, depending on the circumstances, copyright infringers will be notified by platform operators that a copyright infringement report has been received, allowing them to mount a defense.

In this case, my personal information will be sent to the copyright infringer instead..

In other words, depending on the situation, platform operators have created systems that allow for the identification of parties, enabling civil lawsuits. If there is someone claiming to be a victim and someone claiming not to be the perpetrator, they create a link and seem to act as an intermediary that simply introduces the two parties to "fight it out here."

In the case of YouTube, after the video is removed and the infringer objects, they request submission of evidence that the victim is taking legal steps, such as filing a complaint, to seek actual punishment during a 10-day grace period. So, they provided guidance stating that if it is not submitted within the deadline, the punishment will be lifted.

No other platforms have had such cases yet.
